Child Find Notice Washougal School District is committed to addressing the unique needs of students with disabilities ages birth through 21 residing within the boundaries of the Washougal School District. This includes children with disabilities enrolled in private and religious schools as well as children who are living in a temporary situation. Disabilities can be in any one of several areas that ultimately affect a child’s learning, such as the ability to think, to express oneself, to see or hear clearly, to get around, or understand instructions.

If you have a child who you think might have a disability requiring special education instruction or significant accommodations at school, or if you know of such a child, please feel free to call the Washougal School District Special Services Office, (360) 954-3020. Special Education Special Education provides services to students with certain disabilities that are specified in state and federal laws. Services are free of charge to the parent. Anybody may refer a student for an evaluation to determine if the student qualifies for services. The referral needs to be in writing (unless you are unable to write) and directed to the student’s principal. If you suspect that your child has a disability and may require special education services and your child is not currently enrolled in the school district, you may direct the referral to the Special Services Department.

Eligibility for special education services requires that we conduct an evaluation. The results of the evaluation must show that the child has a disability as defined in Chapter 392-172A of the Washington Administrative Code AND that this disability has a negative effect on the child making progress in what is being taught in the general education classroom. If the child is of preschool age, the disability would need to result in the child significantly falling behind in developmentally appropriate activities in areas like adaptive behavior, communication, motor, cognition and behavior. Eligible children/students receive services that meet their individual needs. These services are outlined in an Individual Educational Plan (IEP) that school staff and parents jointly develop.

There are many legal rules and regulations that determine what happens in special education. They are outlined in WAC 392-172A and are written in legal language. Further information may be obtained from the Special Services Department or the Office of the Superintendent of Public Instruction (OSPI). Washougal School District is dedicated to meeting the needs of all children. The Special Education Department services children with disabilities ages 3 to 21. The district contracts with ESD 112 to provide services to children birth to 2-years old. Programs are developed on an individualized basis, determined by the individual needs of each child.

Washougal High School has information available concerning the entrance requirements and the availability of programs in the local area that lead to college credit. These include classes such as advanced placement, running start, tech-prep, skill centers, college in the high school and international baccalaureate programs. In addition, the high school has the names and contact information of other public or private entities offering such programs, including online advanced placement programs, if the school has knowledge of such entities. The Washougal School District provides students with access to various third-party websites, applications, and other online resources in support of student learning. The use of these online resources may involve the collection of a small number of personally identifying information or PII, like the students first and last name, username, and district email address. As permitted under the Children’s Online Privacy Protection Act (COPPA), the district consents to this collection on behalf of parents of children under 13, unless the parent/guardian opts-out. If you have a child under the age of 13 and wish to opt out of your child’s use of online resources, you must contact your child’s school. A meeting will take place with the parent/guardian, principal, and district technology representative to discuss alternative learning solutions. The Family Educational Rights and Privacy Act (FERPA) affords parents and students who are 18 years of age or older (“eligible students”) certain rights with respect to the student’s education records. These rights are:

  1. The right to inspect and review the student’s education records within 45 days after the day the Washougal School District receives a request for access.Parents or eligible students who wish to inspect their child’s or their education records should submit to the school principal [or appropriate school official] a written request that identifies the records they wish to inspect.  The school official will make arrangements for access and notify the parent or eligible student of the time and place where the records may be inspected.
  2. The right to request the amendment of the student’s education records that the parent or eligible student believes are inaccurate, misleading, or otherwise in violation of the student’s privacy rights under FERPA.Parents or eligible students who wish to ask the Washougal School District to amend their child’s or their education record should write the school principal or their designee, clearly identify the part of the record they want changed, and specify why it should be changed.  If the school decides not to amend the record as requested by the parent or eligible student, the school will notify the parent or eligible student of the decision and of their right to a hearing regarding the request for amendment.  Additional information regarding the hearing procedures will be provided to the parent or eligible student when notified of the right to a hearing.
  1. The right to provide written consent before the school discloses personally identifiable information (PII) from the student’s education records, except to the extent that FERPA authorizes disclosure without consent.One exception, which permits disclosure without consent, is disclosure to school officials with legitimate educational interests.  The criteria for determining who constitutes a school official and what constitutes a legitimate educational interest must be set forth in the school’s or school district’s annual notification for FERPA rights.  A school official typically includes a person employed by the school or school district as an administrator, supervisor, instructor, or support staff member (including health or medical staff and law enforcement unit personnel) or a person serving on the school board.  A school official also may include a volunteer,  contractor, or consultant who, while not employed by the school, performs an institutional service or function for which the school would otherwise use its own employees and who is under the direct control of the school with respect to the use and maintenance of PII from education records, such as an attorney, auditor, medical consultant, or therapist; a parent or student volunteering to serve on an official committee, such as a disciplinary or grievance committee; or a parent, student, or other volunteer assisting another school official in performing his or her tasks.  A school official typically has a legitimate educational interest if the official needs to review an education record in order to fulfill his or her professional responsibility.
  2. The right to file a complaint with the U.S. Department of Education concerning alleged failures by the Washougal School District to comply with the requirements of FERPA. FERPA permits the disclosure of PII from students’ education records, without consent of the parent or eligible student, if the disclosure meets certain conditions found in § 99.31 of the FERPA regulations.  Except for disclosures to school officials, disclosures related to some judicial orders or lawfully issued subpoenas, disclosures of directory information (directory information is defined in policy 3231p, and is shared with parents via this annual notification on website), and disclosures to the parent or eligible student, § 99.32 of the FERPA regulations requires the school to record the disclosure.  Parents and eligible students have a right to inspect and review the record of disclosures.  A school may disclose PII from the education records of a student without obtaining prior written consent of the parents or the eligible student –

  • To other school officials, including teachers, within the educational agency or institution whom the school has determined to have legitimate educational interests. This includes contractors, consultants, volunteers, or other parties to whom the school has outsourced institutional services or functions, provided that the conditions listed in § 99.31(a)(1)(i)(B)(1) – (a)(1)(i)(B)(3) are met. (§ 99.31(a)(1))
  • To authorized representatives of the U. S. Comptroller General, the U. S. Attorney General, the U.S. Secretary of Education, or State and local educational authorities, such as the State educational agency (SEA) in the parent or eligible student’s State. Disclosures under this provision may be made, subject to the requirements of § 99.35, in connection with an audit or evaluation of Federal- or State-supported education programs, or for the enforcement of or compliance with Federal legal requirements that relate to those programs.  These entities may make further disclosures of PII to outside entities that are designated by them as their authorized representatives to conduct any audit, evaluation, or enforcement or compliance activity on their behalf, if applicable requirements are met.  (§§ 99.31(a)(3) and 99.35)
  • To State and local officials or authorities to whom information is specifically allowed to be reported or disclosed by a State statute that concerns the juvenile justice system and the system’s ability to effectively serve, prior to adjudication, the student whose records were released, subject to § 99.38. (§ 99.31(a)(5))
  • To organizations conducting studies for, or on behalf of, the school, in order to: (a)  develop, validate, or administer predictive tests; (b)  administer student aid programs; or (c)  improve instruction, if applicable requirements are met.  (§ 99.31(a)(6))
  • To accrediting organizations to carry out their accrediting functions. (§ 99.31(a)(7))
  • To parents of an eligible student if the student is a dependent for IRS tax purposes. (§ 99.31(a)(8))
  • To comply with a judicial order or lawfully issued subpoena if applicable requirements are met. (§ 99.31(a)(9))
  • To appropriate officials in connection with a health or safety emergency, subject to § 99.36. (§ 99.31(a)(10)
  • Information the school has designated as “directory information” if applicable requirements under § 99.37 are met. (§ 99.31(a)(11))
  • To an agency caseworker or other representative of a State or local child welfare agency or tribal organization who is authorized to access a student’s case plan when such agency or organization is legally responsible, in accordance with State or tribal law, for the care and protection of the student in foster care placement. (20 U.S.C. § 1232g(b)(1)(L))
  • To the Secretary of Agriculture or authorized representatives of the Food and Nutrition Service for purposes of conducting program monitoring, evaluations, and performance measurements of programs authorized under the Richard B. Russell National School Lunch Act or the Child Nutrition Act of 1966, under certain conditions.  (20 U.S.C. § 1232g(b)(1)(K))

The Washougal School District supports and enforces drug-free schools.
Use and/or possession of alcohol and illicit drugs is unlawful, wrong, and harmful. A student shall not knowingly possess, use, be under the influence of, or show evidence of having used any alcohol or any controlled illegal, addictive, or harmful substances (including anabolic steroids) while on school grounds or at a school activity.

Violation of this policy shall result in the following:

  • The parent(s) will be notified to discuss appropriate treatment.
  • The school administration may request the assistance of a law enforcement official investigating the source of the substance.
  • Appropriate school disciplinary action will be taken.

To ensure the safety, health and well-being of all students, the district is committed to a program that emphasizes drug and alcohol abuse prevention, intervention, aftercare support and necessary corrective actions. While the primary obligation to seek assistance rests with the student and his/her parent(s), school staff shall work with the home and community to develop and implement a comprehensive prevention and intervention program. The district shall seek the support and cooperation of public and private agencies as necessary.

Section 952B of the No Child Left Behind Act, also known as Armed Forces Recruiter Access to Students and Student Recruiting Information, requires schools to provide student contact information to military recruiters and institutes of higher education unless a parent has opted out of providing such information.

NAEP is the largest nationally representative and continuing assessment of what America’s students know and can do in various subject areas. The Federal No Child Left Behind Act requires the NAEP assessment be given in reading and mathematics at grades 4 and 8 every two years. States and school districts that receive Title I federal funding to help students in high poverty areas must participate in these assessments, and their pilot assessments. The Washington Legislature enacted the Parent Bill of Rights proposed under Initiative 2081.

The law covers a number of topics, and parents can review the session law here.

Parents have the right to:

  • Inspect their child’s school records in accordance with RCW 28a.605.030 and to receive a copy of the records within 10 days either electronically or on paper. (electronic files are provided at no cost, charges may apply for photocopies of records as set forth in board policy 4040 Public Access to District Records). Parents should contact their child’s school office to request records.
  • Receive notification when medical services are offered to their student, except when emergency medical treatment is required.
  • Receive notification when medical services or medication are provided to a student that could result in a financial impact for the family, their insurance, or copays.
  • Receive notification if the school arranges for medical treatment that results in follow-up care beyond school hours, such as medication, medical devices, monitoring for aches, pains, or emotional care.
  • Receive notification if a criminal action is deemed to have been committed against or by their child.
  • Receive notification if law enforcement question their child, except when the parent or legal guardian has been accused of abusing or neglecting the child.
  • Receive notification if their child is removed from the school campus to be taken to a youth shelter or host home defined in RCW 74.15.020.
  • Not be discriminated against based on the religious beliefs of the family.
  • Receive written notice and the option to opt out of surveys, assignments, questionnaires, role playing, recordings, or other activities that include discussion of the child’s sexual experience or attraction; the families beliefs, morality, religion, or political affiliation; mental or psychological problems in the family; surveys, analyses, and evaluations.
  • Opt their child out of instruction on topics associated with sexual activity in accordance with RCW 28a.300.475.
  • Receive the school calendar no later than 30 days prior to the start of the school year, and to be notified as soon as is feasible when the calendar is revised. The calendar must include student attendance days and events that require student or parent attendance outside of the school day or hours.
  • Receive a list or be able to view a list of required fees on the school website, the purpose of the fee, and hardship information for families.
  • Be informed if a students academic performance could result in the student not being promoted to the next grade level, and an opportunity for an in-person meeting with the teacher and principal to discuss resources and strategies to encourage the students’ academic improvement.

Washington State law requires all school districts to adopt a pesticide policy and related procedures for implementing the policy. Our district will take steps to promote a safe and healthy environment for children, staff, parents and others who visit the schools. Information regarding the use of pesticides in the district is available at the district office.

The district recognizes its responsibility to provide a working environment for employees and a learning environment for students that is free from all types of discrimination, including sexual harassment and bullying. Sexual harassment is illegal, and procedures have been developed that provide for receiving and investigating a complaint from any staff member or student. Focusing on strengths and identifying areas for growth are essential attributes of high quality schools. Schools develop a School Improvement Plan, usually a 3 year focus with goals in literacy, math, and school climate, to engage in a series of strategies and activities with regular assessments on the efficacy of the work. Federal law permits parents of children in Title I Schools to request information on the professional qualifications of their child’s teachers. Specifically, parents have the right to ask for the following information:

  • Whether OSPI has licensed or qualified the teacher for the grades and subjects he or she teaches.
  • Whether OSPI has decided that the teacher can teach in a classroom without being licensed or qualified under state regulations because of special circumstances.
  • The teacher’s college major; whether the teacher has any advanced degrees and, if so, the subject of the degrees.
  • Whether any teacher’s aides or similar paraprofessionals provide services to your child and, if they do, their qualifications.
